As you know, the Department of Labor recently released the long awaited final regulations for the Fair Labor Standards Act.  Implementing the new salary requirements correctly may be fairly straight forward for employers. However, the duties tests remain complicated and are often misapplied.

Click here for an updated chart that explains each of the more common exemptions so that you can properly classify your employees.  The actual test for each exemption is on the left and there are definitions, tips and examples on the right.

If you need assistance in reviewing job classifications, you should always consult an experienced employment attorney, such as the author.
