On April 26, 2016, the Department of Labor (DOL) issued a 76-page guide to the FMLA for employers, “The Employer’s Guide to The Family and Medical Leave Act.” The Guide can be downloaded from www.dol.gov/whd/fmla/employerguide.htm.
The Employer Guide is a useful reference for basic issues, e.g., coverage, reasons for leave, employee and employer notice requirements, etc. It also contains a “road map” and several charts, references to the FMLA regulations, along with a link to the DOL’s FMLA web page. The DOL’s web page has up-to-date FMLA forms, numerous fact sheets, and the new April 2016 version of the mandatory FMLA poster. Employers do not have to post the new poster yet.
The Employer Guide provides lots of user-friendly information on general matters. For questions regarding specific circumstances in your workplace, which often involve additional issues such as disability or workers’ compensation, employee handbooks or collective bargaining agreement provisions, consult experienced employment counsel, such as the author.
